West Virginia Attorney General Patrick Morrisey was part of a lawsuit against the NCAA regarding their transfer rules.
Morrisey who has been an advocate for West Virginia’s RaeQuan Battle, who he cited in the announcement of the lawsuit.
The lawsuit was filed in West Virginia, and challenges the NCAA’s transfer eligibility rules. The other states involved were Ohio, Colorado, Illinois, New York, North Carolina, and Tennessee.
“Every athlete must be treated fairly and no organization is above the law. I’m pleased to join this bipartisan effort and believe the law is on our side. It’s time for change to come to the NCAA,” Morrisey said.
Morrisey later added that he filed a separate ruling saying they asked the court for a temporary restraining order against the NCAA in order for the transfer rule to not be applicable.
The release reads:
“The NCAA’s transfer policy, for far too long, has been flawed. The Association has failed to maintain a consistent and defensible transfer rule,” Attorney General Morrisey said, writing in the lawsuit that “the connection between the Rule and academic well-being or athletic amateurism is tenuous at best and is outweighed by the harm it does to college athletes and consumers of college athletics.”
The lawsuit says the NCAA’s transfer rule “artificially deters players and teams from achieving optimal matches by forcing college athletes to weigh the one-year ineligibility period against the benefits of moving to a better matched school. It is ironic that this rule, stylized as promoting the welfare of college athletes, strips them of the agency and opportunity to optimize their own welfare as they see fit.”
